Seminar Overview

Legal Requirements Under and Beyond the Strata Management Act 2013 (Act 757). This seminar will address the legal issues and practical challenges involving contracts, compliance with the Act, procurement of management services and management agreements. The following points will be discussed:

Seminar Outlines

 1. Requirements under Act 757

  • Statutory authority: The developer, JMB or management corporation must act within its statutory powers when appointing management service providers.
  • Contract duration: Observe applicable statutory restrictions, particularly the JMB’s 12-month limit under section 21(3) of the Act.
  • Fair procurement: Establish proper procurement procedures and ensure a fair and transparent tender process under the applicable Regulations.
  • Financial accountability: Ensure expenditure is properly authorised, justified and recorded.
  • Continuing responsibility: Appointing a property manager does not absolve the JMB or MC of its statutory duties

2. Requirements beyond Act 757

  • Professional compliance: Verify registration and qualifications under the Valuers, Appraisers, Estate Agents and Property Managers Act 1981, where applicable.
  • Due diligence: Assess the service provider’s competence, experience, financial standing and track record.
  • Contractual safeguards: Clearly define scope of services, KPIs, fees, liabilities, indemnities, termination and handover obligations.
  • Regulatory compliance: Address applicable employment, safety, licensing, data protection and anti-corruption laws.
  • Good governance: Ensure competitive selection, disclosure of conflicts of interest, transparency and ongoing performance monitoring.

Key takeaway from the seminar can be summarised as follows:

“The power to appoint is not a licence to spend without scrutiny.”

Lawful procurement requires more than a valid appointment. It demands statutory compliance, professional competence, financial prudence, contractual protection and accountability. Outsource the services, not the responsibility.

The seminar is intended to help property managers, developers, joint management committees and management committees, commissioners of buildings and homeowners generally to grasp the necessary details, procedures and requirements.
