Management bodies of residential associations (RAs) or strata developments are artificial entities managed by human minds through its committee members subject to the restrictions imposed by its general meeting, the governing statutes and by-laws or its founding constitution for RAs.
General meetings of proprietors play a vital role in strata schemes. The Strata Management Act 2013, Second Schedule provides for meetings to be held periodically, quorum, methods of casting votes and how notice of meetings are to be given. However, little guidance is given for the substantive discussions and the proceedings of meetings itself. If the meeting of proprietors are not managed properly by adhering to perimeters of the laws, rules of natural justice, proper decorum and in the spirit of co-existence, general meetings can quickly become grounds to breed divisive and destructive politics.
This seminar will provide useful guidance on how maintenance and management are to be determined collectively, what sort of restrictions can be imposed on management committee’s managerial discretions, how to effectively address proprietors issues and how to invoke the applicable laws and regulations to control unreasonable, unruly or defiant behaviours of some proprietors at general meetings.
